Conditions of Use

This document contains the general terms and conditions of sale governing online purchases made for all operational purposes by Micromegas Comunicazione Srl., as identified below, through the site SHOP.TRIPTOITALY.TRAVEL (the "Site"), based in Via Flaminia, 999 - 00189 Rome, P.IVA 01570111003. 

The products and services purchased on the Site are sold directly by Micromegas Comunicazione Srl., based in Via Flaminia, 999 - 00189 Rome, P.IVA 01570111003 (the "Seller").

The Seller reserves the right to change these General Terms and Conditions of Sale at any time; any new rules will be effective from the time of their publication on the Site and will apply to sales made from their publication. 

The Seller urges you to read these General Terms and Conditions of Sale carefully before making any purchase through the Site. 

1. Definitions

Customer: the Consumer, as defined below.
Order Confirmation: notice sent to the Customer by electronic mail, providing the final details regarding the purchase contract entered into between Seller and Customer (of which these Terms of Sale are an integral part).
Consumer: a natural person, of age or otherwise capable of acting in accordance with the law, who places an order on the Site for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out subject to the regulations set out in Legislative Decree no. 206/2005 and subsequent amendments and additions.
Price: the contractual consideration indicated in the Order Confirmation, including VAT.
Product(s): the products in the electronic catalog published on the Site, as described in the relevant product sheets and detailed in the Order Confirmation.
Seller: Micromegas Comunicazione Srl., with registered office in Via Flaminia, 999 - 00189 Rome, P.IVA 01570111003, registered in the Company Register of Rome n°xxxxx, commercial company with which the Customer concludes the purchase contract
On the other hand, these Conditions of Sale do not regulate the provision of services or the sale of products by parties other than the Seller that are present on the Site through any links, banners or other hypertext links. Before placing orders to purchase products and/or services from parties other than the Seller, the Customer is urged to check their Terms of Sale. The Seller, in fact, is not responsible for the provision of services by third parties other than the Seller or the conclusion of e-commerce transactions between users and third parties.
In the event of a computer, manual, technical, or any other error that may result in a substantial change, not foreseen by the Seller, in the sale price to the public, making it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the customer will be refunded within 14 days from the day of cancellation, after notifying the customer.
The seller reserves the right to verify and evaluate the correctness and good faith of the Customer, especially in case of using promotions or discount coupons. If the Customer's conduct is found to be unlawful and improper, the seller will promptly notify the Customer and proceed with the cancellation of the purchase order.
These Terms of Sale are posted on the home page of the Site, can be viewed by the Customer at any time before and during the process of placing an order, and are automatically accepted with the submission of the order.

2. How to conclude the contract with Micromegas Comunicazione Srl.

To conclude the contract for the purchase of one or more products on shopon.it, the Customer must fill in the order form in electronic format, taking care to correctly enter their data as requested in the form itself and transmit it electronically to the Seller, following the instructions given on the Site.
The Customer, assumes responsibility for the truthfulness and correctness of the personal data entered and issued to the Seller when registering and sending the order form. It is understood that any damage/delay/discomfort referable to and/or attributable to the incorrectness and/or untruthfulness of the personal data entered at the time of registration and/or subsequently modified shall in no case be charged to the Seller.
In the order form is a summary of the main information related to each Product ordered. In particular, the price (including VAT), the means of payment that can be used and the mode of delivery of the ordered products (accompanied by the relevant costs) are made explicit.

Before proceeding to the purchase of products through the transmission of the order form, it is the Customer's obligation to carefully read the General Conditions of Sale, as well as to print and/or save a copy of them for possible future use. By concluding the online purchase procedure and payment, the Customer accepts these Terms of Sale and may print or save an electronic copy and otherwise store these Terms of Sale in accordance with the provisions of Legislative Decree no. 206/2005 ("Consumer Code").
The contract is concluded when, following the Customer's verification of the order data, the Seller receives the corresponding order form electronically.
With the transmission of the order form, the Customer unconditionally accepts and undertakes to observe, in his dealings with the Seller, these Conditions of Sale. If the Customer does not agree with any of the terms herein, the Customer is requested not to submit the order form for the purchase of products on shopon.co.uk
By submitting the order form, the Customer confirms that he/she also knows and accepts the additional information contained in shopon.co.uk's privacy policy.   
The language available to the Customer to conclude the contract with the Seller is Italian.
Product prices may be subject to updates. The Customer has the obligation to ascertain the final sale price before submitting the relevant order form.
Once the contract is concluded, the Seller will take charge of the corresponding purchase order.
The Seller may not process purchase orders submitted by the Customer if sufficient guarantees of solvency are not provided or if the data provided by the Customer are incomplete or incorrect. In any case, orders placed by minors under the age of 18 will not be accepted. In these cases, the Seller will, by e-mail, inform the Customer of the non-conclusion of the contract, indicating the reasons why it was not possible to follow up the order.
In general, all items on shopon.it are immediately available. Shopon.it may also offer for sale items of imminent/future availability specifying it clearly within the product sheet.
The Seller shall in no event be held liable for the temporary unavailability of one or more products. If specific products presented on shopon.it are no longer available or on sale after the submission of the order form, it will be the Seller's responsibility to notify the Customer, prior to the Order Confirmation, of such unavailability. Without prejudice to what is agreed below (see section "Right of Withdrawal"), the sending of the order form by the Customer, shall also be considered as acceptance of a possible partial delivery, limited to the products available within those ordered, as well as a waiver of the right to claim compensation and/or indemnity for this reason. If the Customer has already paid for the complete order, the Seller will refund the portion corresponding to the unavailable products in the manner described below (see section "Timing and Method of Refund").
Once the contract is concluded, the Seller will send to the Customer, at the e-mail address in the order form, a document of "Receipt of Order" sent by the Customer, summarizing the information contained in the form itself. This document is not intended as the "ORDER CONFIRMATION", which will be sent later, at the time of the actual shipment of the Products.
At the time of the actual shipment of the products in the order form, the Seller will send to the Customer, at the e-mail address and in the language indicated, the Order Confirmation. This document will contain the list of the products actually purchased accompanied by their main characteristics, including that relating to the price including VAT. It will also contain, in addition, all information regarding shipping data, costs and expected delivery times. In addition, the total cost of the order (with and without VAT) and the main information regarding the payment made will be indicated. Finally, the document in question will contain the Seller's tax data (Name, Legal Form, Registered Office, Registration with the Registrar of Companies, Tax Code, VAT No. and Person in charge).

3. Cancellation of the Order

Without prejudice to the provisions regarding withdrawal, it is possible to cancel orders that have not yet been processed by contacting Customer Service by email: info@shopon.it
It is not possible to cancel an order once the shipping process has begun.
In the event that, at the time of cancellation of an order, the corresponding payment has already been made, it will be necessary to contact Customer Service in order to proceed with the refund procedure (as described in the section "Refund Times and Methods").

4. Guarantees

The Seller offers for sale goods produced by third-party companies. The goods offered for sale are described in the respective product sheets with specific indication of the BRAND/MARK affixed by the manufacturing company. All products marketed are original and of identical quality to the standard products offered on the market by the manufacturers themselves (irregular or substandard products are not marketed).
The essential characteristics of the products are indicated on the Site at each Product detail page. However, the images and colors of the products offered for sale may not correspond to the real ones due to the effect of the Internet browser and monitor used. It is therefore understood that, without prejudice to the indications on the label, the Customer shall not be able to claim any exception against the Seller and/or the Supplier, in the event that the packaging and/or the product delivered does not coincide with the image of the Product shown on the Site as to colors/shape/size. In fact, the Vendor reserves the right to change the packaging of the Product at any time.
The Seller pays the utmost attention to the adherence of what is described and presented on Shopon.it with respect to what is stated on the label on the Product packaging. In any case, it is emphasized that, where differences are found, the label and the directions for use of the Product provided by the manufacturer will always prevail.
At the time of delivery by the courier of the Product purchased, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the packaging is intact, not damaged, or wet or otherwise altered, even in the sealing materials (adhesive tape or metal strapping). 
Upon receipt of the Products, the Customer must: 
ensure that the packaging is intact. If this is not the case, he/she must NOT collect the Products and leave them with the courier. If this occurs, the Customer must promptly notify the Seller in order to allow the problem to be resolved quickly;
photograph the package - if the Products received are damaged or incomplete/incorrect - both outside and inside so that, in the event of a claim, the Seller may request such material to verify the actual problem.
Once the courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered and the risk of loss or damage of the Products will transfer to all effects to the Customer.
The Seller Micromegas Comunicazione Srl recognizes on all products the legal guarantee of conformity referred to in articles 128-135 of the Consumer Code.
The Customer may request the replacement of the non-conforming product by specifying the reason "warranty for non-conforming product", the order code and the reason for the return through the email info@shopon.it. The Seller, having verified compliance with the above, will send, through its Customer Service, an email to the Customer of "return opening" containing the procedure to be followed for the return of products (see Return procedure). The Seller will arrange for an express courier to pick up the defective Product, directly to an address indicated by the Customer. Following receipt of the product, the Seller, in agreement with the Supplier, will assess the actual alteration and, in case of a positive finding, will, if possible, replace the goods at its own expense or refund, within the period of 30 days from the date of receipt of the return. In case of negative feedback, the Seller will promptly notify the Customer of the negative outcome of the return procedure, to whom no replacement product will be sent. In any case, the Customer may, at its own expense, collect the product from the Seller no later than 30 days after the communication of the negative outcome of the procedure.
The conformity warranty on products will apply correctly if the following conditions are also fully met: 
the email requesting the opening of return procedure contains the information regarding the order code and reason for return; 
the returned products are sent to the Seller in a single shipment.

Seller shall not be liable or obligated to pay any indirect, intangible or collateral damages, including. The warranty under consideration is valid only for products purchased by a Customer residing within the territory of Italy.
The limitation of liability set forth in the Articles shall not apply in case of fraud, willful misconduct or gross error committed by the Seller.
The Guarantee of Conformity of the products is reserved for Customers of shopon.it finds application only to those users who have made the purchase on the Site for purposes unrelated to the entrepreneurial, commercial, craft or professional activity possibly carried out. To those who have purchased on the Site and who do not hold the quality of Customers will be applied the warranties for defects of the thing sold, the warranty for defect of promised and essential qualities and the other warranties provided for by the Civil Code with the relevant terms, forfeitures and limitations. Excluded from the scope of the Guarantee of Conformity of the products are any defects caused by accidental facts or by the responsibility of the user or by a use of the product that does not comply with its intended use and/or with what is provided in the instructions for use of the product and labels as well as in cases where the user stores the products in unsuitable places or exposed to bad weather, dirt or contaminating agents.

5. Payments

Seller will only accept payments in Euro currency.
For payment of the price of the products and related shipping and delivery costs, the Customer may use one of the methods indicated in the order form.
In case of payment by credit card, the entire payment procedure will be handled, in absolute security, by the payment gateways STRIPE and PayPal. Consequently, the Seller will never be in possession of any sensitive information (e.g., full credit/debit card number, or security code).

6. Shipping and Delivery Products

Shipping will take place within two working days from the time of payment, all shipments on Italian territory (peninsula) of standard size have a cost of € 7.90 € (islands € 10.90). 
For the purchase of furniture or objects particularly fragile or delicate or of a significant volume and weight will be quantified the specific cost of transport when closing the order.
The Seller ships its products every working day in Italy by courier and arrival times may vary depending on the destination. On average, delivery by courier takes 3-7 business days (i.e., Monday through Friday) from receipt of the order form. In any case, the Seller reserves the right to deliver the ordered products within the maximum period of 30 days from the Order Confirmation email.
The Seller agrees to make every effort to meet the above delivery times, but shall in no event be held liable for any damage or inconvenience caused by any delay.
The cost for each shipment, associated with an order, may vary depending on the following parameters: the place of destination and the total weight/volume of the Products purchased with the individual order, and will in any case be made explicit both during the order transmission procedure and in the Order Confirmation. The Seller reserves the right to offer shipping as a free accessory to the order. In any case, the free or cost of shipping will be communicated to the consumer before proceeding with the purchase.
All of the above costs are inclusive of VAT to the extent of applicable law.
Delivery by shipment is intended to be street level and will be made, unless otherwise specified, Monday through Friday during normal business hours (9:00 a.m. to 6:00 p.m.), excluding national holidays and only within the national territory.

 


7. Customer Support

The Customer may request any additional information from the Seller by contacting Customer Service via email at info@shopon.it or via the form provided on the Contact area of the Site. 

8. Privacy .

Privacy information is contained in the Privacy Policy.

9.  Sales regulations and recipients

a. These Conditions of Sale are governed by Italian law and in particular by the Consumer Code, with specific reference to the regulations on distance contracts and Legislative Decree April 9, 2003 No. 70, specifically art. 1, art. 18, art. 19.
b. These Terms and Conditions of Sale shall also be amended from time to time in consideration of any regulatory changes. The new Terms and Conditions of Sale shall be effective as of the date of their publication on shopon.co.uk. For any dispute that may arise in relation to these Terms of Sale and to the supplies and orders, respectively, made and forwarded under them, for the case in which the Customer is a Consumer will be competent, pursuant to Article 66-bis of the Consumer Code, the judge of the place of residence or domicile of the Customer-Consumer, if located in the Italian territory.
c. The following conditions are addressed to all users who purchase from the seller Micromegas Comunicazione Srl on the website Shopon.it
d. The access and use of the Shopon.it website as well as the purchase of products presuppose the reading, knowledge and acceptance of these Conditions of Sale.
